A probate lawyer a manages the filing of the last testament or will of a decedent. A probate lawyer is often referred to as an estate or trust lawyer. As a probate lawyer I take a personal representative through the entire probate process from start to finish. The exact steps needed for any particular probate can differ based on whether the decedent died intestate to meeting with a valid last will and testament, or into state, meaning without a will. I am well-versed in the probate laws of California where I am also licensed to practice real estate.

What does a Probate Attorney Do?

When someone passes away and the executor is winding up the estate there’s a lot of legwork to be done. Making phone calls and gathering documents are just some of the tasks done by the executor however, there are some situations where appropriate attorney is required. Not everything needs to be done through a probate lawyer. Ordering death certificates, filing the will with the local probate court, ordering appraisals and filing final income tax returns can be done by the executor if there is one. However, answering certain questions about the probate process, drawing up court papers, and dealing with beneficiaries and creditors may all be handled with a probate attorney.

It’s important to check in regularly for legal advice throughout the probate process. Even the lawyers work on an hourly basis, you can gather all of your documents and questions and ask about the proceeding all at the same time. It’s important to be efficient when you communicate, and this is why a free consultation may be necessary to determine what documents and questions you may actually have.
